People
often try to solve a problem but create another one. When they
are in debt they often try to reduce their monthly payments by
taking out a high-interest debt consolidation loan. They then
find out, too late, that they still cannot afford the payment;
but now, instead of an unsecured loan, they have one that is
secured by some of their precious property Or,
they give up and not even investigate further to see if there
is some other solution to their problem. Before you decide to
take these courses of action, or inaction, do yourself a favor
by checking out some other possibilities. Having the
information provided here or with the free
consultation, you will be able to avoid some of the traps
that are out there.
Having been a lawyer since
1972, most of which time has been spent helping my clients
with financial problems, I can understand what you must be
going through. Since I work extensively in the area of
Bankruptcy Law, Chapter 7 and 13, perhaps I could suggest some
solutions to your financial problems that you may not have
thought of. After graduating from law school I
spent six an a half years as an attorney with the Internal
Revenue Service. Do you have tax problems?
Did you know that it is possible to wipe out Federal, State
and local income taxes? Before you choose a supposed
solution to your tax problems offered by finance companies,
check out bankruptcy. If you incur debt to
pay taxes it is possible that you may never wipe it out;
but filing bankruptcy can.
If
you do nothing about the law suit, the creditor will get
judgment against you. When that happens, if the law suit is
for a foreclosure of your home, a sheriff’s sale will be
ordered for the disposal of your home. If the law suit is for
something else, upon judgment the creditor can garnishee your
wages, attach property or place liens on your real estate.
None of these results is desirable.
Most people have a
misconception about Bankruptcy; they think of it as somehow
illegal or dishonorable. Nothing can be further from the
truth. Federal Law allows honest, hardworking people like you
to use the law to get out of debt legally, honorably, and with
dignity and to stop
the foreclosure of their homes.
And the costs are quite
modest. For instance, my office will file a Chapter 7 for you
for as little as $395.00
in lawyer fees plus court costs of $299.00.
We will file a Chapter 13 for you with NO
UP-FRONT LAWYER FEES in appropriate cases, plus court
costs. If you qualify, all you would have to pay
UP-FRONT to STOP a
foreclosure of your home in a Chapter 13 is the court
cost of $274.00. It
is even possible to pay court costs in installment of three
payments. AND, some may even qualify to have court
costs entirely WAIVED.
No attorney will
defer attorney fees in a Chapter 7 bankruptcy beyond the
filing date. You may have heard some
advertisements claiming that "attorney fees may be
deferred". It is true; but only in a chapter
13 since most, if not all of the attorney fees may be paid
over the life of the Chapter 13 Plan. With a
Chapter 7 it is different; all fees must be paid before filing
of the petition since any attorney fees remaining will be
wiped out with the Chapter 7 bankruptcy. No one
will work for someone when they are not even permitted to ask
for payment after the matter is over.

Should you decide not to do anything, there is no
